Nelson Hardiman recently resolved a dispute between a drug rehab and a Medi-Cal contractor regarding the payment of services. In particular, the Medi-Cal contractor had unexpectedly stopped paying for services that are supposed to be covered by the Drug Medi-Cal program. After thoroughly examining this largely obscure body of law, Nelson Hardiman challenged the payment stoppage and threatened to sue the Medi-Cal contractor. Nelson Hardiman argued the contractor had a legal duty to pay for the services and was in violation of State law by refusing to pay. Ultimately, the Medi-Cal contractor backed down and resumed making payments before a lawsuit could even be filed.
